Agreement Ratification

Ratification of the agreement to be a member of Kashtah and to reserve places through the application or getting any services through it, you are required to register as a member. By filling in and ratifying the registration form, the user agrees to be bound by the user agreement of Kashtah.

Kashtah reserves the right to modify these Terms of Use at any time without prior notice. You agree that each visit you make to the sites shall be subject to the then-current Terms of Use, and continued use of the site now or following modifications in these Terms of Use confirms that you have read, accepted, and agreed to be bound by such modifications.

General Overview and Description of Service

(a) Kashtah provides an online platform that allows its partners (Place owners) to advertise their places for reservation, and allows the users to view these places and reserve them.

(b) By making a reservation through Kashtah, you are entering into legally binding contractual relationship with the place owner. You are also agreeing to the cancellation policy provided by the place owner.

(c) Once a reservation is made, an email will be sent to the user and the place owner. It is ultimately the responsibility of the user to ensure that they are present on a timely manner, and the place's responsibility to provide the access to the place and the other available facilities.

(d) Although we will use reasonable skill and care in performing our services we will not verify if, all information is accurate, complete or correct, nor can we held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), in accurate, misleading or untrue information or non-delivery of information. Each place owner remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website.

Indemnity

You agree to indemnify Kashtah against any losses, damages, costs, liabilities and expenses and reasonable attorney fees incurred or suffered by us arising out any breach by you of any provision of these terms and conditions.

Governing Law

These Terms shall be governed by and construed in accordance with Bahrain law. Disputes arising in connection with these Website Terms (including non-contractual disputes) shall be subject to the exclusive jurisdiction of the Bahrain courts.

Cancellation and No-Show Policy

Kashtah reserves the right to cancel any reservations that might be deemed to be based on inaccurate information provided while registering. Your reservation may be cancelled if we cannot reach you in order to verify from the details provided. By making this reservation you are agreeing to the cancellation and no show policy agreed between Kashtah and the place owner.

• Failing to adhere to the cancellation time notice above might affect your ability to make future reservations with the place owner. If the same happens on 3 different reservations, you will not be able to make future reservations using Kashtah.
• You will not be able to make future reservations using Kashtah in case of a no-show. Contact details will be also be forwarded to the place owner.
• Kashtah is not responsible or liable in any way for reservations made directly with the place owner. Cancellations for these reservations have to be made by contacting the place owner. If your reservation needs to be cancelled by the place owner due to circumstances outside the control of Kashtah. You will be noticed as soon as the place owner contacts Kashtah.

Down Payment

The down payment which is paid for booking through the application is non-refundable for any reason, including cases of death, or for any other circumstance, unless there is a clear error or technical issue occurred on the part of the Kashtah application.

Users Privacy Policy

We respect your privacy and are committed to protecting the personal data you provide when using our mobile application.

• Personal data (such as name, email address, phone number) that you voluntarily provide when registering or using our services.

Nothing in the disclaimer will: limit or exclude our or your liability for death or personal injury resulting from negligence. limit or exclude our or your liability for fraud or fraudulent misrepresentation. limit or exclude our or your liabilities in any way that is not permitted under applicable law; or exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and exclusions of liability set out in this section and elsewhere in this disclaimer: (a) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.
